Copyright and Intellectual Property Policy

1. Introduction
This Copyright & Intellectual Property Policy ("Policy") explains the ownership, protection and permitted use of the intellectual property made available through the QS Assistant website, online learning platform and associated educational services (the "Platform").
QS Assistant Ltd has invested significant time, expertise and resources in developing practical educational materials for the construction industry.
This Policy is intended to:
protect our intellectual property;
explain how our Content may be used;
protect the rights of third-party intellectual property owners;
explain how copyright concerns may be reported.
This Policy forms part of our Terms of Use.
2. Ownership of Intellectual Property
Unless expressly stated otherwise, all Intellectual Property Rights in the Platform and its Content are owned by or licensed to QS Assistant Ltd.
This includes, without limitation:
learning modules;
educational programmes;
course structures;
competency mapping;
learning pathways;
presentations;
educational videos;
audio narration;
written content;
articles;
assessments;
quizzes;
examination questions;
answer banks;
worked examples;
case studies;
graphics;
illustrations;
diagrams;
animations;
icons;
page layouts;
website design;
user interface elements;
branding;
logos;
trade marks;
Certificates;
downloadable resources;
software;
databases;
source code;
documentation; and
all future educational content developed by QS Assistant.
These works are protected by copyright, database rights, trade mark law, design rights and other applicable intellectual property legislation.
3. QS Assistant Trade Marks
The following, whether registered or unregistered, are proprietary assets of QS Assistant Ltd unless otherwise stated:
QS Assistant;
QS Assistant Ltd;
the QS Assistant logo;
product names;
programme names;
course names;
branding;
graphical identity;
distinctive visual elements.
Nothing within this Policy grants permission to:
reproduce our branding;
register confusingly similar names;
register similar domain names;
use our branding in advertising;
imply affiliation with QS Assistant.
Written permission must be obtained before using our trade marks.
4. Third-Party Intellectual Property
The Platform may refer to third-party organisations, legislation, standards, contracts, software products and professional institutions for educational purposes.
These may include, without limitation:
Royal Institution of Chartered Surveyors (RICS);
Chartered Institute of Building (CIOB);
Institution of Civil Engineers (ICE);
Chartered Institution of Building Services Engineers (CIBSE);
Association for Project Management (APM);
NEC Contracts;
JCT Contracts;
FIDIC;
government departments;
software providers;
recognised standards; and
other industry organisations.
All names, logos, trade marks, service marks, publications and other intellectual property relating to such organisations remain the property of their respective owners.
References to third-party organisations are provided solely for legitimate educational, descriptive or informational purposes.
Nothing within the Platform should be interpreted as implying endorsement, sponsorship, accreditation, approval or affiliation unless expressly stated in writing.
5. Licence Granted to Users
Subject to compliance with our Terms of Use, QS Assistant grants each authorised user a limited, personal, non-exclusive, non-transferable and revocable licence to access the Platform for their own personal education and professional development.
This licence permits you to:
access educational materials included within your Subscription;
complete Assessments;
download your own Certificates;
use knowledge acquired through the Platform in your professional activities.
No ownership of Intellectual Property Rights is transferred to you.
6. Permitted Use
You may:
study educational materials;
take personal notes;
complete Assessments;
download your own Certificates;
print your own Certificates;
refer to concepts learned through the Platform within your professional work.
You may also make limited copies where expressly permitted by applicable copyright legislation, including fair dealing where applicable.
Any wider use requires our prior written permission.
7. Prohibited Use
Unless expressly authorised by QS Assistant in writing, you must not:
reproduce learning modules;
copy substantial parts of educational materials;
redistribute presentations;
reproduce videos;
reproduce narration;
reproduce assessments;
publish assessment questions;
publish answer keys;
upload Content to another website;
reproduce learning pathways;
remove copyright notices;
remove branding;
commercially exploit Platform Content;
create competing educational products;
adapt Content into another training programme;
sell or license Platform Content;
create derivative works based upon substantial portions of our Content.
8. Artificial Intelligence
QS Assistant does not permit its proprietary educational materials to be used for the training or development of artificial intelligence systems without prior written permission.
Accordingly, you must not use Platform Content to:
train artificial intelligence models;
train large language models;
train machine learning systems;
develop generative AI tools;
create AI datasets;
improve commercial AI products;
generate competing educational materials through automated extraction.
Nothing within this Policy prevents reasonable personal use of AI tools for your own learning, provided that you do not upload substantial portions of QS Assistant's proprietary educational content or otherwise infringe our Intellectual Property Rights.
9. AI-Assisted Production Tools
QS Assistant may use carefully selected production technologies to enhance the presentation and accessibility of educational materials.
These may include:
Gamma, for presentation layouts and graphics;
ElevenLabs, for audio narration; and
other similar production tools introduced from time to time.
These tools assist in the production and presentation of educational materials only.
Unless expressly stated otherwise, all educational content, technical explanations, professional commentary, assessments, competency mapping and instructional materials are independently researched, authored, reviewed and approved by QS Assistant Ltd.
Ownership of all resulting educational content remains with QS Assistant Ltd unless otherwise stated.
10. Copyright Notices
All copyright notices, branding, logos and proprietary notices displayed on the Platform must remain intact.
You must not remove, obscure, alter or modify any copyright or proprietary notice appearing on any Content.
11. Reporting Copyright Infringement
QS Assistant respects the intellectual property rights of others.
If you believe that material available through the Platform infringes your copyright or other intellectual property rights, please contact us with:
your full name;
your contact details;
a description of the work claimed to have been infringed;
the location of the allegedly infringing material;
evidence of your ownership or authority to act on behalf of the rights holder;
a statement that you believe the complaint is made in good faith.
We will investigate all legitimate notifications promptly and, where appropriate, remove or restrict access to the material while the matter is reviewed.
12. Infringement by Users
Where QS Assistant reasonably believes that a user has infringed intellectual property rights, we may:
issue a warning;
require removal of infringing material;
suspend the user's Account;
terminate access to the Platform;
revoke Certificates obtained through misuse;
pursue legal remedies where appropriate.
These actions are in addition to any other rights available under our Terms of Use or applicable law.
13. Changes to this Policy
QS Assistant may amend this Policy from time to time to reflect:
changes in legislation;
developments in technology;
changes to our Services;
improvements to the Platform;
changes to industry practice; or
other legitimate business requirements.
The latest version of this Policy will always be published on the Platform.
