Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("Policy") explains the standards of behaviour expected from every user of the QS Assistant website, learning platform and associated services (the "Platform").

The purpose of this Policy is to:

protect the integrity of the Platform;

safeguard our educational resources;

protect the rights of other users;

maintain a secure learning environment;

protect the intellectual property of QS Assistant Ltd.

This Policy forms part of our Terms of Use.

By accessing or using the Platform, you agree to comply with this Policy.


2. Scope

This Policy applies to:

visitors;

registered users;

subscribers;

Business Customers;

authorised employees;

learners;

organisations purchasing access;

anyone accessing any part of the Platform.

It applies regardless of the device or location from which the Platform is accessed.


3. General Responsibilities

When using the Platform, you agree to:

act honestly and responsibly;

comply with applicable laws;

respect the rights of other users;

protect your Account;

protect confidential information;

respect QS Assistant's Intellectual Property Rights;

use the Platform solely for legitimate educational purposes.

You remain responsible for all activity undertaken using your Account unless it results from our own negligence or a security incident beyond your control.


4. Account Security

You must:

maintain the confidentiality of your login credentials;

choose a secure password;

notify QS Assistant immediately if you suspect unauthorised access;

ensure that information associated with your Account remains accurate.

You must not:

share your Account;

allow another person to use your login credentials;

purchase another user's Account;

sell your own Account;

create multiple Accounts to avoid Platform restrictions;

impersonate another person or organisation.


5. Lawful Use

The Platform may only be used for lawful purposes.

You must not use the Platform in any way that:

breaches applicable law;

infringes another person's rights;

facilitates unlawful activity;

promotes fraud;

promotes violence;

promotes discrimination;

promotes harassment;

promotes hate speech;

promotes criminal activity.


6. Protection of Educational Content

The educational resources available through the Platform represent a substantial investment of professional knowledge, expertise and intellectual property.

Unless expressly authorised in writing, you must not:

copy learning modules;

reproduce educational materials;

redistribute presentations;

reproduce assessments;

publish assessment questions;

publish answer keys;

remove copyright notices;

remove branding;

create derivative educational products;

commercially exploit Platform Content.

Limited copying expressly permitted by applicable copyright law, such as fair dealing, is unaffected.


7. Artificial Intelligence

You must not use the Platform or its Content to:

train artificial intelligence systems;

train machine learning models;

train large language models;

develop commercial AI products;

create datasets;

generate competing educational materials through automated extraction.

Reasonable personal use of AI tools to support your own learning is permitted, provided you do not upload substantial portions of QS Assistant's proprietary educational content or otherwise infringe our Intellectual Property Rights.


8. Automated Access

You must not use:

web scrapers;

bots;

spiders;

crawlers;

robotic process automation;

automated downloading tools;

browser automation;

data harvesting software;

automated account creation tools.

You may only access the Platform through interfaces intentionally provided by QS Assistant.


9. Security

You must not:

attempt to gain unauthorised access;

interfere with Platform security;

probe security vulnerabilities without permission;

interfere with authentication systems;

upload malicious software;

distribute malware;

introduce viruses;

interfere with servers;

interfere with databases;

attempt denial of service attacks;

reverse engineer Platform software except where prohibited by law.

If you discover a security vulnerability, you should report it responsibly to QS Assistant without publicly disclosing it.


10. Assessments

Users must complete Assessments honestly.

You must not:

impersonate another learner;

submit work on behalf of another person;

arrange for another individual to complete an Assessment;

manipulate Assessment software;

exploit technical vulnerabilities;

publish assessment content;

distribute answer keys.


11. Certificates

Certificates must only be used by the individual to whom they were issued.

You must not:

alter Certificates;

forge Certificates;

falsify completion dates;

remove branding;

transfer Certificates;

sell Certificates;

claim another person's Certificate as your own.

Misuse of Certificates may result in revocation.


12. Respect for Other Users

You must not:

harass another user;

bully another user;

intimidate another user;

impersonate another user;

interfere with another user's access;

submit offensive material;

submit defamatory material;

submit discriminatory material;

submit obscene material;

submit unlawful material.


13. Monitoring

To protect the Platform, QS Assistant may, where lawful and proportionate, monitor:

login activity;

subscription usage;

security events;

Account sharing indicators;

Assessment activity;

compliance with this Policy.

Monitoring is carried out in accordance with our Privacy Policy and applicable data protection legislation.


14. Enforcement

Where we reasonably believe this Policy has been breached, QS Assistant may:

issue a warning;

require corrective action;

suspend access;

terminate an Account;

revoke Certificates;

remove access to educational materials;

recover outstanding Fees;

pursue legal remedies;

report unlawful activity to relevant authorities.

We will exercise these powers reasonably, proportionately and in accordance with applicable law.


15. Appeals

If you believe enforcement action has been taken incorrectly, you may contact QS Assistant to request that the decision be reviewed.

Any appeal should include sufficient information to enable us to investigate the matter.

Submission of an appeal does not automatically suspend the enforcement action while it is under review.

QS Assistant will consider appeals fairly and notify you of the outcome within a reasonable period.


16. Changes to this Policy

QS Assistant may amend this Policy from time to time to reflect:

changes in legislation;

improvements to the Platform;

changes to our Services;

security developments;

technological advances; or

other legitimate business requirements.

The latest version of this Policy will always be available on the Platform.
